Decision No. 346/QĐ-BNV issued by the Ministry of Home Affairs, provides guidance on updating, amending, and supplementing administrative procedures applicable to foreign employees working in Vietnam under the management authority of the Ministry of Home Affairs.

Decision 346 takes effect from the date of signing and simultaneously repeals Decision No. 886/QĐ-BNV (“Decision 886”).

Decision 346 expands the documentation requirements under Decree No. 219/2025/NĐ-CP (“Decree 219”), particularly with respect to supporting documents for managers, executives, experts, and technical workers in the following cases:

• Issuance of a new Work Permit (WP) for experts and technical workers who have already been granted a valid WP and wish to work for a different employer in the same job position and field of work;
• Issuance of a new WP for experts and technical workers who have previously had their WP extended and wish to continue working for the same employer in the same job position and field of work;
• Extension of a WP for managers, executives, experts, and technical workers.

Pursuant to Decision 346:

• Experts and technical workers in cases (i), (ii), and (iii) are required to re-submit documents proving their professional qualifications and relevant work experience as part of the application dossier for issuance or extension of a WP.
• Managers and executives in case (iii) are required to re-submit documents certifying their managerial or executive positions, such as the company charter, enterprise registration certificate, appointment decision, or other relevant internal documents.
• These documentation requirements were not previously stipulated under Decree 219 or Decision 886. Therefore, enterprises are recommended to closely monitor these legal updates to ensure full compliance with the revised dossier requirements.
