Decree No. 337/2025/NĐ-CP dated December 24, 2025 issued by the Government on the conclusion and performance of electronic labor contracts is summarized as follows:

1. Regarding regulations on the conclusion and performance of electronic labor contracts:
- Pursuant to the Labor Code No. 45/2019/QH14 and the Law on Electronic Transactions No. 20/2023/QH15;
- Pursuant to the provisions of law on cyber information security, digital data, electronic identification and authentication;
- Pursuant to the prevailing regulations on the development and operation of electronic contract platforms.
Based on the above provisions:
- Decree No. 337/2025/NĐ-CP clearly stipulates that an electronic labor contract is a contract concluded and performed in the form of a data message and has legal validity equivalent to that of a paper-based written labor contract;
- The conclusion of electronic labor contracts must comply with labor laws, electronic transaction laws, regulations on information security, personal data protection, and the provisions of this Decree;
- Electronic labor contracts shall be sent to employees and employers in the form of data messages via appropriate electronic means as agreed by the parties;
- The State encourages the use of electronic labor contracts to replace paper-based contracts in human resource management and related administrative procedures.
2. Regarding conditions for the development and use of the electronic labor contract platform:
- The Decree provides for the development, updating, management, maintenance, operation, exploitation, and use of the Electronic Labor Contract Platform, for which the Ministry of Home Affairs shall take primary responsibility for organizing and implementing;
- This platform shall connect data from the central to local levels, ensuring the unified use of data for transactions, storage, and retrieval of electronic labor contracts;
- Relevant ministries and agencies shall coordinate in connecting and sharing data between the platform and national databases, and concurrently review and adjust administrative procedures to facilitate the use of electronic labor contracts.
3. Regarding effectiveness and implementation:
- Decree No. 337/2025/NĐ-CP takes effect from January 01, 2026;
- No later than July 01, 2026, the Electronic Labor Contract Platform must be officially put into operation; from this date onward, the conclusion and performance of electronic labor contracts shall be carried out in accordance with the provisions of this Decree.
